I General Terms

1. These terms and conditions for using the car park relate to entering and using the Hotel Nafta Krosno car park, which belongs to Investimus Sp. z o.o., hereinafter referred to as the “Owner”.
2. The Hotel Nafta Krosno car park is a PAID, UNGUARDED car park.
3. Parking jest czynny całą dobę we wszystkie dniu roku.
4. An agreement for using a parking space is concluded when entering the car park using a magnetic card or after collecting a parking ticket from the machine. The agreement ends when leaving the car park. Proof of concluding the agreement is the parking ticket or a valid parking card.
5. The conditions for using a parking space are: a) collecting a parking ticket or having a magnetic card,
   b) signing an agreement with Investimus Sp. z o.o. for using the parking space in an abonnement (subscription) system.
6. By entering the car park, the vehicle user expresses agreement to the terms and conditions set out in these regulations.

II Liability

1. The Owner is not responsible for damage resulting from theft, destruction or damage to the vehicle caused by the Vehicle User, by third parties, or by force majeure, occurring within the car park premises. The Owner is not responsible for items left in the Vehicle User’s vehicle or forming part of the equipment of the Vehicle User’s vehicle.
2. The Vehicle User is required to secure the vehicle against unauthorised persons gaining access to its interior and to use the security systems they have.
3. Subject to the provisions of these regulations, the parties’ liability is governed by the relevant provisions of the Civil Code.
4. If damage is caused or incurred at the car park, the User has the right to approach the Owner to request securing the monitoring footage.

III Rules for Using the Car Park

1. Traffic rules apply in the car park, including road signs, whether vertical or horizontal. Regardless of the above, each Vehicle User is obliged to follow instructions from the staff on duty.
2. Vehicles may be left only in designated parking spaces.
3. Parking is prohibited at entrances, exits, lanes, crossing/drive-through areas, pedestrian crossings, spaces marked “DO NOT PARK”, or in other places not designated for parking.
4. If, by parking incorrectly, the User prevents or blocks traffic within the car park premises, the Owner is entitled to impose a contractual penalty (for parking not in accordance with the regulations) in the amount of 250 zł.
5. The following are prohibited on the car park premises: a) using open flames,
   b) drinking alcohol,
   c) storing fuel, flammable substances and empty fuel containers,
   d) refuelling vehicles,
   e) leaving vehicles with the engine running,
   f) parking vehicles with leaking systems,
   g) washing and vacuuming vehicles,
   h) replacing cooling water, fuel or oil,
   i) driving the vehicle without dipped headlights switched on,
   j) riding on roller skates and skateboards,
   k) carrying out any other actions not described above that could breach or threaten safety.
6. At the car park, there is an absolute ban on entering with vehicles transporting any kind of firearms and hazardous materials, in particular flammable, corrosive and explosive materials, as well as any other such materials—unless the holder has the appropriate authorisation and any hazardous material in the vehicle is secured in accordance with applicable regulations.
7. The owner is entitled to remove from the car park premises vehicles and persons that do not comply with the above bans.

IV Rules for entering and exiting the car park

1. When entering the car park, the Vehicle User must obligatorily: a) stop at the ticket machine,
   b) raise the barrier by taking a parking ticket from the machine or by holding a magnetic card up to the reader.
2. When exiting the car park, the Vehicle User must obligatorily: a) stop at the ticket machine,
   b) raise the barrier by scanning the parking ticket paid for at the car park cash desk or by holding a magnetic card up to the reader.
3. When exiting, it is prohibited to drive under an open barrier with two vehicles, or to drive under an open entrance barrier. The entrance and exit barriers close immediately after each vehicle.
4. If the above bans are not followed, the Vehicle User bears the costs related to damage to the car and the car park’s automatic service system, in accordance with the agreed repair costs.

V Parking fee, length of stay

1. The parking fee for using a parking space is charged in proportion to the parking time, according to the rate card for each occupied parking space.
2. The rate card for parking fees is posted before entering the car park.
3. The prices shown in the rate card include VAT at 23%.
4. The parking fee must be paid before leaving the car park at the car park cash desk located by the main entrance to the Hotel.
5. To pay the parking fee at the car park cash desk, you must: a) insert the ticket into the reader,
   b) pay the required amount according to the parking rate card (the required amount is displayed automatically),
   c) the payment machine accepts banknotes of 1 zł, 2 zł, 5 zł, 10 zł, 20 zł, 50 zł, 100 zł and automatically gives change in coins,
   d) The paid ticket must be kept with you when leaving the car park.
6. No parking discounts or parking rebates can be processed at the car park ticket office. If you have any, you must report to the Reception of Hotel Nafta Krosno.
7. Any irregularities in the operation of, or payment collection via, the car park ticket office must be reported at the Reception of Hotel Nafta Krosno.
8. Po opłaceniu biletu należy w ciągu 15 min. opuścić parking. Przekroczenie ustalonego czasu na wyjazd skutkuje naliczeniem dodatkowej opłaty zgodnie z cennikiem.
9. W przypadku zgubienia biletu parkingowego Użytkownik pojazdu jest zobowiązany do uiszczenia opłaty w wysokości 30 zł za każdy dzień postoju pojazdu na parkingu.
10. The owner issues VAT invoices for the use of parking spaces, on request from the User.
11. Appropriate formal and legal steps will be taken against customers who refuse to pay the fee.
12. The following persons or vehicles are exempt from parking fees: a) Guests of Naftaya Restaurant,
    b) Hotel Nafta Krosno staff,
    c) Supplies for Hotel Nafta Krosno,
    d) Privileged vehicles.

VI Complaints and suggestions

1. Complaints and suggestions related to the use of the car park should be submitted in writing to the Owner: Investimus Sp. z o.o., ul. Lwowska 21, 38-400 Krosno.

VII Final provisions

1. This Regulations enter into force on 22 June 2016.
2. The content of these Regulations is available on the Hotel website at www.nafta.pl, on the Naftaya Restaurant website at www.naftaya.pl, on the Pub & Club Nafta website atwww.club.nafta.plas well as at the Reception of Hotel Nafta Krosno.
3. Hotel Nafta Krosno is obliged to make the Car Park Use Regulations available upon every request made by the User.
4. The Hotel reserves the right to change the Regulations. Any changes to the content of the Regulations will be updated on an ongoing basis and made available on the websites as well as at the Reception of Hotel Nafta Krosno.
5. For matters not covered by these Regulations, the relevant provisions of the Civil Code shall apply.
